GENERAL BOOKING CONDITIONS OFWWW.MYSKYBUS.COM
1.- IDENTIFICATION OF THE PARTIES.
On the one hand MYSKYBUS SHUTTLE, S.A., hereinafter MYSKYBUS SHUTTLE, whose other identifying details are contained in the Legal Notice and owner of the domain WWW.MYSKYBUS.COM, hereinafter Website, and on the other hand; the User, the one who contracts the services offered through the Website. MYSKYBUS SHUTTLE and the User may, depending on the context, be referred to as the party/s.
2.- SCOPE OF APPLICATION, ACCEPTANCE, AND MODIFICATION.
The present general booking conditions, hereinafter referred to as GRCs, govern the booking contracts between MYSKYBUS SHUTTLE and the User, irrespective of the channel used: Website, e-mail or telephone call.
The User, who declares that he/she has sufficient legal capacity* to enter into a contract, shall be bound by these terms and conditions as soon as he/she makes a reservation through any of the channels indicated above.
The GRC may be subject to unilateral modification by MYSKYBUS SHUTTLE without prior notice, however, the User will be bound to those in force at the time of making the booking.
Any special conditions that may be applicable, or the modification of these terms and conditions, must be formalized by means of a separate document, which, in order to be effective, must be signed by both parties.
*LEGAL LIMITATIONS: It is understood that the User is not a minor under 18 years of age. Minors are technically restricted from registering on this website and therefore may not make purchases or reservations, in compliance with legal regulations. Data sent by minors will not be processed, as this is prohibited by law.
3.- OBLIGATIONS OF THE PARTIES.
3.1.- Obligations of MYSKYBUS SHUTTLE:
To provide the services in accordance with the GRC and without breaching contractual good faith.
To place at the disposal of the User the GRC and the particular conditions which, where applicable, are applicable.
To send the User a receipt or invoice for the services contracted.
3.2.- Obligations of the User:
To carry out full compliance with the provisions of the GTC.
To complete the registration forms with truthful and current information. The User will be solely responsible for the accuracy and updating of the information.
Maintain the confidentiality of the information provided and immediately notify the loss, loss, theft, robbery, illegitimate access, as well as its knowledge by third parties.
To act in a diligent manner, at all times conforming to the canons of good use and good contractual faith throughout the contractual relationship.
No User who is under the influence of alcohol or other drugs may board the bus. The driver and the company reserve the right not to allow any User in such a state to board the bus.
It is strictly forbidden to drink alcohol or smoke in a vehicle.
In any case, the health measures in force at the time must be respected.
4.- BOOKING AND PAYMENT CONDITIONS. PRE-CONTRACTUAL AND CONTRACTUAL PERFECTION.
Reservations can be made, as indicated above, through the Website or by telephone.
To book a trip, the User may do so via the Website by entering the corresponding details and paying the amount indicated on the website. The service may always be booked at least 48 hours in advance. If this is the case, it must be done by telephone so that the office can check if there is availability.
The service provided corresponds to the transfer from the airport to the towns on the Costa Blanca that appear on the website, and vice versa, from the towns to the airport in question. The service may be contacted by any person traveling to any of the main destinations, or departing from or traveling to or from any of the destinations along the MYSKYBUS SHUTTLE route. A maximum of five stops will be made during the service.
The waiting time at the airport will be between 1 hour and 1 hour and 30 minutes. In the event of flight delays, or if you are unable to travel on the scheduled service, you will be facilitated to travel on the next immediate service departing to your destination. The waiting time at the airport after the flight arrival will be between 30 minutes and 1 hour.
Booking Process:
The User making the booking, if making the booking for more than 1 person, shall be responsible for the veracity of all passenger details. He/she must be of legal age and accept the booking conditions for him/herself and for the whole group.
The booking process must be done through the Website, however, it can be done by phone in case you need help.
Once you have paid the total amount of the booking, you will be able to download the tickets on the same website, and you will also receive the ticket(s) by e-mail with information about the area you are going to visit.
The tickets will contain the details of the booking, except for the exact pick-up time, which will be sent by e-mail between 24h-36h before the service is provided.
The ticket must be shown to the driver when boarding the bus so that it can be validated.
It is the User's responsibility to check that the details of the reservation are correct and if this is not the case, he/she should contact us.
In the event that the User uses their own seat to transport their baby, they do so at their own risk.
Children from 0-2 years of age do not pay for a ticket if they travel in the arms of an adult, but children from 3 to 12 years of age must pay for a normal ticket, as they occupy a seat in the same way as an adult.
However, in the event of a change in the booking conditions, the User will be informed in advance via the Website or by e-mail.
The parties shall not be bound until the contract has been perfected both in the pre-contractual and contractual phases.
5.- PRICES AND APPLICABLE TAXES.
The published prices include the corresponding VAT. The User will be able to find out the amount of these costs at the time of contracting the product.
MYSKYBUS SHUTTLE reserves the right to modify the list of prices published on the Website when it considers it appropriate. In any case, the above will not be applicable to those services contracted prior to the modification.
6.- FORMS OF PAYMENT
The User has the following means of payment available:

7.- TRANSFER OF RISK AND OWNERSHIP.
The responsibility of the carrier is the responsibility of the company that actually performs the service.
The transport company shall not be liable for non-compliance that is not directly attributable to it, nor for those produced by unforeseen circumstances, force majeure, or due to legal or administrative requirements. Likewise, it shall not be held responsible for any loss of connection of its services with other transports, its own, or those of third parties.
MYSKYBUS SHUTTLE is in no way responsible for any loss and/or damage caused to the User and the occupants during the service contract.
MYSKYBUS SHUTTLE may modify or cancel any of the essential elements of the service contract in the event of force majeure or unforeseen circumstances.
8.- PROCEDURE, CANCELLATION AND WITHDRAWAL RIGHTS, AND LEGAL GUARANTEE.
8.1.- Procedure.

8.2.- Right of Cancellation.
Cancellation may only be made via the MYSKYBUS SHUTTLE web page, or by telephone.
In case of cancellation:
Before 48h the full amount of the ticket price will be refunded.
Between 48h and 24h, a deduction of 50% of the total price paid will be made.
If the cancellation is made within 24 hours, no refund will be made.
If the User does not show up at the place and time of departure, the trip will be forfeited and there will be no right to an exchange of the ticket or reimbursement of the amount paid.
8.3.- Right of Withdrawal.
This is the right of the User to cancel a contract in certain cases without having to justify their decision or incur any penalty. In accordance with Article 93 k) of Royal Legislative Decree 1/2007 approving the Consolidated Text of the General Law for the Defence of Consumers and Users, the regulation of distance sales (with the exception of Article 98.2) does not apply to passenger transport service contracts. Therefore, the right of withdrawal does not apply to passenger transport service bookings.
9.- MISCELLANEOUS PROVISIONS.
- LUGGAGE
The passenger will have the right to transport up to 10 kg of luggage with dimensions of 40x20x25cm with the purchase of the ticket.
The transport of extra luggage is subject to a supplement on the ticket price, which can be found when making a reservation on the website, as well as the price of the extra services offered.
Luggage must be transported in the hold of the bus. Small objects or hand luggage may be carried, provided that they do not pose a nuisance or danger to other passengers and are properly placed on the trays at the top of the seats, never in the aisles or between the legs.
LOST ITEMS
In the event of loss or damage to luggage or any object on our transport services, you should contact our offices indicating the reservation number and details of the journey: day, time and route. If the object has been located, it can be collected.
10.- BREACH OF CONTRACT.
Both contracting parties must proceed to the fulfillment of the obligations assumed in the present contract in the terms established throughout the same. In the event that either party fails to fulfill any of the essential obligations of this contract, or fulfills them in a defective manner, the party that in turn has fulfilled its own obligations may consider that there has been a breach of contract in the terms established in article 1.124 of the Civil Code, being entitled to choose between terminating the contract or demanding performance, claiming, in both cases, the corresponding compensation for damages and losses.
11.- NOTIFICATIONS.
MYSKYBUS SHUTTLE designates its address for the purpose of noticing the address stipulated in the Legal Notice. The e-mail address provided by the User during the registration process will be used by MYSKYBUS SHUTTLE for the purposes of notifications. All notifications made in accordance with the procedure indicated will be considered to have been validly made.
12.- COMPETENT JURISDICTION.
In the event of litigation between the parties, the territorial jurisdiction will correspond, at the choice of the User, to the domicile of the latter or of the defendant.
